Chapter 7 Fees and Costs

Most personal bankruptcy cases under Chapter 7 are uncontested.  Resolvency will charge an attorney’s fee of $1,450 for an uncontested Chapter 7 personal bankruptcy in Washington.  There is also a filing fee of $335.00 paid directly to the clerk of the Court.

Additional attorney’s fees will be charged if litigation is required to determine the dischargeability of certain debt, avoid liens, defend actions for relief from stay, or defend an adversary proceeding.

Chapter 13 Fees and Costs

Chapter 13 bankruptcy cases require the development of a Chapter 13 plan for the payment of all disposable income to creditors for a period of three to five years.  Chapter 13 cases are more complex than Chapter 7 cases and involve a higher attorney’s fee.  Resolvency will charge an attorney’s fee of $1,000 prior to filing a Chapter 13 bankruptcy in Washington, and additional fees will be payable from the payments that are made under the Chapter 13 plan.  There is also a filing fee of $310.00 paid directly to the clerk of the Bankruptcy Court.

Payment in Installments

Attorney’s fees can always be paid in installments prior to the bankruptcy filing, and the court will accept payment of the filing fee installments when needed.
